General terms and conditions of sale

GTC

Article 1- Scope:

These General Terms and Conditions of Sale (referred to as “GTC”) apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers (“Customers or the Customer”), who wish to purchase the products offered for sale (“Products”) by the Seller on the website https://lapatededom.com. The Products offered for sale on the website are as follows:

  • Recipe cards in PDF format.

PDF files are digital documents that can be downloaded and viewed on various digital devices (smartphones, tablets, computers…). PDF files are not nominative. They can be purchased by one person (“the buyer”) and used by a third party (“the beneficiary”). The choice and purchase of a recipe card are the sole responsibility of the Customer. These GTC are accessible at any time on the website https://lapatededom.com and shall prevail over any other document. The Customer declares having read and accepted these GTC by ticking the box provided for this purpose before implementing the online ordering procedure on the website https://lapatededom.com. Unless proven otherwise, the data recorded in the Seller’s computer system constitutes proof of all transactions concluded with the Customer.

Article 2- Buyer and object:

The order and purchase of PDF documents are made via the website https://lapatededom.com. Once the purchase is made, PDF files are non-refundable and non-exchangeable.

Article 3- Pricing and payment terms:

The items (PDF files) are provided at the prices in effect on the website https://lapatededom.com at the time of the order registration by the Seller. Prices are expressed in euros, VAT included. The prices take into account any discounts that may be granted by the Seller on the website https://lapatededom.com. These prices are firm and non-revisable during their validity period, but the Seller reserves the right, outside the validity period, to modify the prices at any time.

The payment of the price of the items is due from the validation of the order. The final validation of the order occurs after the payment validation. The payment is made in full, online by credit card or by Paypal on the day of the validation of the order by the Buyer. Paypal allows payment by credit card without having to create a PayPal account.

The online registration of the credit card number and the final validation of the order shall constitute proof of the completeness of the order in accordance with the provisions of the law of 13 March 2000 and shall result in the amount due for the items entered on the order form becoming payable.

Article 4- Payment methods for PDF files:

4.1. Online payment

PDF files can be paid for via the “La Pâte de Dom” website, by credit card or PayPal. Payment is made in full, online by credit card or PayPal on the day the order is validated by the Buyer. PayPal allows for payment by credit card without the need to create a PayPal account.

The “La Pâte de Dom” website is secured by a secure payment platform called Stripe. However, “La Pâte de Dom” reminds users that it is important to protect themselves against unauthorized access to their password and computer. If you share a computer, you must take the necessary steps to ensure that a third party cannot access your personal data.

4.2. Placing the order

The buyer places their order by completing the following steps:
Step 1 : The Buyer clicks on the “Add to Cart” button.
A message appears at the top of the page allowing the buyer to access the order form via the cart.
Step 2 : The Buyer clicks on the “View Cart” button in order to finalize their purchase.
A new window opens allowing the buyer to access the order validation process and finalize their purchase.
If the Buyer has a “promo code”, they must enter it in the space provided in order to benefit from it, then click on the “Validate Order” button.

3 options are then available to the Buyer:

  • This person does not have an account on the ‘La Pâte de Dom’ website.

The Buyer will need to create their account during the ordering process.
The creation of their password will be requested via an email that they will receive after finalizing the order.
Step 3 : The Buyer completes the mandatory fields (First Name, Last Name, Address, Country, Email Address).
Fields marked with an asterisk (*) are mandatory fields.
Step 4 : The Buyer chooses their payment method: by credit card (via Stripe) or by PayPal.
Step 5 : The Buyer completes the mandatory fields by entering their banking information.

Banking information is managed by the Stripe payment platform and is not transmitted to “la Pâte de Dom” in any way.
The total amount including taxes for the order is then displayed in the summary.
The Buyer has the option to save this payment information on their account for future purchases.
Step 6 : The Buyer will be asked to check the box “I have read and accept the General Terms and Conditions of Sale” (GTC), which they fully consent to having read.
Before validating their order, if the Buyer has a “promo code,” they will once again have the option to enter it in the designated space (at the top of the page) in order to benefit from it.
Step 7 : The Buyer clicks on the “Order” button to finalize their order.
Step 8 :Once payment is made, the Buyer accesses a purchase confirmation page. They can then download the ordered Articles by clicking on the “Download” button.
Step 9 : An order confirmation email is sent to the Buyer at the email address they provided during the order. This email contains the direct download links for the ordered Articles.
Step 10 : The download links for the ordered articles remain available at any time on the Buyer’s account under the “Download” tab..

  • This person already has an account on the “la Pâte de Dom” website but is not logged in.

The Buyer must log in by clicking on the link at the top of the page – “Already a customer? Click here to log in”.
Step 3 : All required fields (First name, Last name, Address, Country, Email address) will be automatically filled in.
Step 4 : The Buyer chooses the payment method: by credit card (via Stripe) or by Paypal.
Step 5 : The Buyer completes the required fields by providing their banking information.
Fields marked with an asterisk (*) are mandatory fields.
Banking information is managed by the Stripe payment platform and is not transmitted to “la Pâte de Dom” in any way.
The total amount including taxes is then indicated in the summary.
The Buyer has the option to save this payment information for future purchases.
Step 6 : The Buyer will be asked to check the box “I have read and accept the General Terms and Conditions of Sale” (GTC) and agrees to have fully read and understood them.
Before validating the order, if the Buyer has a “promo code”, they will once again have the opportunity to enter it in the designated area (at the top of the page) to take advantage of it.
Step 7 : The Buyer clicks on the “Order” button to finalize the order.
Step 8 : Once the payment has been made, the Buyer is directed to a purchase confirmation page. They can then download the ordered items by clicking on the “Download” button.
Step 9 : A confirmation email of the order is sent to the Buyer at the email address they provided during the order process. This email includes direct download links for the ordered items.
Step 10 : The download links for the ordered items remain available at any time on the Buyer’s account under the “Download” tab.

  • This person is already logged in with their account on the “la Pâte de Dom” website.

The total amount including tax for the order is then indicated in the summary.
The buyer has the option to save this payment information on their account for future purchases.
Step 5 : The buyer will be asked to check the box “I have read and accept the General Terms and Conditions of Sale” (GTC) which they agree to have fully understood.
Step 6 : Before validating their order, if the buyer has a “promo code”, they must enter it in the designated area (at the top of the page) to take advantage of it.
Step 7 : The buyer clicks on the “Order” button to finalize their order.
Step 8 : Once the payment is made, the buyer is directed to a purchase confirmation page. They can then download the ordered items by clicking on the “Download” button.
Step 9 : A confirmation email of the order is sent to the buyer at the email address they provided during the order. This email contains the direct download links for the ordered items.
Step 10 : The download links for the ordered items remain available at any time on the buyer’s account under the “Download” tab.

Article 5- Right of withdrawal:

The download of PDFs is not limited in time from the date of purchase.
PDFs are not refundable or exchangeable.
No other Article (PDF) will be provided if the first one is lost by the Buyer or the Recipient.

Article 6- Privacy and personal data:

The Client is informed that the collection of their personal data is necessary for the sale and delivery of the Products, entrusted to the Seller. This personal data is collected solely for the execution of the sales contract.

6.1 Collection of personal data

The personal data collected on the https://lapatededom.com website includes :

• Account creation
• When creating a Client / user account:
• First name, last name, postal address, telephone number, and email address.
• Payment

In the context of payment for the Articles offered on the https://lapatededom.com website, it records financial data related to the Client/user’s credit card.

6.2 Recipients of personal data

Personal data is reserved for the sole use of the Seller.

6.3 Data controller

The data controller is the Seller, within the meaning of the French Data Protection Act and from May 25, 2018, the European General Data Protection Regulation (GDPR).

6.4 Limitation of processing

Unless the Client expressly agrees, their personal data will not be used for advertising or marketing purposes.

6.5 Data retention period

The Seller will keep the data collected for a period of 5 years, covering the time of the applicable civil liability prescription.

6.6 Security and confidentiality

The Seller implements organizational, technical, software, and physical measures to ensure digital security and protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the internet is not a completely secure environment, and the Seller cannot guarantee the security of information transmission or storage on the internet.

6.7 Implementation of Clients and Users’ rights

In accordance with the regulations applicable to personal data,

In order to update or delete their personal data, they can log into their account and go to the ‘account settings’ tab:

  • They can delete their account by writing to the email address indicated in Article 9.3 “Data Controller”
  • They can exercise their right of access to know the personal data concerning them by writing to the address indicated in Article 9.3 “Data Controller”.
  • If the personal data held by the Seller are inaccurate, they can request the updating of the information by writing to the address indicated in Article 9.3 “Data Controller”.
  • They can request the deletion of their personal data, in accordance with the applicable data protection laws, by writing to the address indicated in Article 9.3 “Data Controller”.
  • They can also request the portability of data held by the Seller to another service provider.
  • Finally, they can object to the processing of their data by the Seller.

These rights, as long as they do not contradict the purpose of the processing, can be exercised by sending a request by mail or by email to the Data Controller whose contact details are indicated above.

The Data Controller must respond within a maximum of one month.
In the event of a refusal to comply with the Client’s request, it must be justified.
The Client is informed that in the event of a refusal, he may file a complaint with the CNIL (3 place de Fontenoy, 75007 PARIS) or refer the matter to a judicial authority.
The Client may be asked to check a box stating that he accepts to receive informative and advertising emails from the Vendor. He will always have the possibility to withdraw his consent at any time by contacting the Vendor (contact details above) or by following the unsubscribe link.

Article 7- Ownership:

The PDF files offered by La Pâte de Dom are the property of La Pâte de Dom. The reproduction, representation, and publication of the PDF files offered by La Pâte de Dom are authorized for exclusively private or non-commercial use, provided that the authorship of the document is respected by indicating, on the medium of distribution or presentation of the document and at the bottom of it, in an apparent and legible manner, the mention “document offered by La Pâte de Dom”.

Article 8- Dispute:

These general sales conditions are subject to French law. Any claim related to the purchase of PDF files must be addressed in writing to Dominique DURPOIX at 38 route de Gironville, 91490 Milly-la-Forêt. (or by e-mail: contact@lapatededom.fr) The data recorded on the site may be used as evidence of communications between the parties, reservations made by the client, and transactions between La Pâte de Dom and the Buyer. Any dispute between La Pâte de Dom and the Buyer concerning these general sales conditions, failing an amicable solution, will be the responsibility of the Courts within the jurisdiction of the Court of Appeal of Paris.
